Terms of Service

These terms are a contract between you and Onlyform, Inc. By creating an account, using the service or clicking to accept, you agree to them. If you are agreeing on behalf of an organisation, you confirm you have the authority to bind it.

Onlyform lets you build conversational and single-page forms, collect responses, analyse them and send them to other tools. We may add, change or remove features over time. If we remove something you rely on, we will give reasonable notice.

You are responsible for your account, for keeping credentials secure and for everything that happens under it. Tell us promptly if you suspect unauthorised access.

You must be at least 16 to use Onlyform. One person may not maintain multiple free accounts to avoid plan limits.

Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled. Cancelling stops the next renewal; it does not refund the current period.

We may change pricing with at least 30 days’ notice before it applies to your next renewal. Taxes are added where required. Failed payments may lead to downgrade or suspension after we have tried to reach you.

The free plan is provided as-is and may change or end. Trials of paid features run for the stated period and convert only if you choose to subscribe. We may limit or withdraw a trial if it is being abused.

You may not use Onlyform to:

• Collect data unlawfully, or without the consent or notice the law requires.
• Send spam, run phishing, or impersonate any person or organisation.
• Host malware, or link to it from a form.
• Collect payment card numbers, full government identifiers or health data in plain fields outside the features designed for them.
• Infringe anybody’s intellectual property or privacy rights.
• Probe, scrape, overload or reverse engineer the service, or circumvent plan limits.

We may remove a form or suspend an account that breaches this section, and will tell you why where we are able to.

You own your forms and the responses you collect. You grant us a limited licence to host, process and display that content solely to provide the service to you.

You are the controller of the responses you collect and are responsible for having a lawful basis, giving respondents the notices they are due and honouring their requests. Our data processing agreement forms part of these terms where data protection law applies.

We do not sell your data and we do not use the content of your responses to train models.

Onlyform, our software, templates, documentation, brand and marks remain ours. Templates may be used inside your own forms; they may not be repackaged or resold as a competing template library.

Connecting a third-party tool is between you and that provider, under their terms. We are not responsible for what they do with data you send them, and we may stop supporting an integration if the provider changes or withdraws its API.

Where you collect payments in a form, the payment processor is the merchant of record for that transaction and their terms apply to it. You are responsible for the goods or services you sell, for refunds, for chargebacks and for any tax due. Onlyform is not a party to the transaction.

We aim for high availability but do not guarantee uninterrupted service on Free or Pro plans. Business and Enterprise plans may include a service level commitment in an order form. Planned maintenance is announced on our status page.

You may close your account at any time from your settings. We may suspend or terminate an account for a material breach of these terms, for non-payment, or where we are legally required to.

On termination we stop processing and delete your data 30 days later, unless a longer period is required by law. Export your data before you close the account.

Except as expressly stated, the service is provided as-is and as-available. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be error-free or that it will meet your specific requirements.

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential loss, or for lost profits, revenue or data. Our total aggregate liability in any 12-month period is limited to the amount you paid us in that period. Nothing here limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.

You agree to indemnify us against third-party claims arising from your content, your use of the service in breach of these terms, or your breach of data protection law in relation to responses you collect.

We may update these terms. For material changes we will give at least 30 days’ notice by email and in the product. Continuing to use Onlyform after the change takes effect means you accept the updated terms.

These terms are governed by the laws of the jurisdiction named on our contact page, and the courts there have exclusive jurisdiction. Before starting proceedings, both parties agree to try to resolve the dispute informally for 30 days.
